Confidentiality in the Family Court of WA

It's common knowledge that the media cannot publish the names of the parties in Family Court proceedings. This maintains the confidentiality of Family Court proceedings, which is extremely important. If a media outlet breaches this confidentiality, it may face severe consequences.

The Courier-Mail, a newspaper based in Brisbane, published photographs and the names of a mother and her four children who live on the Sunshine Coast in 2012. The mother and her children were involved in a custody dispute with the children's father in Italy.

Judge Terence Martin SC of the Brisbane District Court recently fined the Courier-Mail $120,000 for their actions. His Honour stated that,

''this was persistent, serious offending in deliberate defiance of the law and importantly in complete disregard of the interests of four children.''
